You retain ownership of the original videos and content you upload to OptiSwing. How we process and use the data you upload is described in our Privacy Policy.

You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to upload and use all content you submit, and that such content does not violate any third-party intellectual property, privacy, or publicity rights.

You agree not to upload content that is unlawful, infringing, or violates these Terms.

2. AI & Accuracy Disclaimer

The Service uses artificial intelligence and computer vision technologies that are probabilistic in nature and may produce inaccurate, incomplete, or misleading results.

All metrics, visualizations, and qualitative feedback are estimates derived from machine learning models and are not medical, biomechanical, or scientific measurements. The Service is provided for informational and educational purposes only.

We do not guarantee the accuracy, reliability, or effectiveness of any analysis, nor do we guarantee that use of the Service will improve your tennis performance. The Service is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind.

3. Physical Safety & Health Disclaimer

OptiSwing is not a medical provider and does not provide medical advice.

Tennis is a physically demanding sport. You voluntarily assume all risks associated with athletic activity, including the risk of injury or physical harm. You should consult a qualified physician or professional coach before making changes to your training regimen based on insights from the Service.

To the fullest extent permitted by law, OptiSwing is not liable for any injury, physical distress, health complication, or death resulting from your use of the Service or reliance on its insights.

4. Intellectual Property & Feedback

All rights, title, and interest in the OptiSwing platform—including its software, design, features, and proprietary algorithms—are owned by OptiSwing LLC.

If you provide feedback, suggestions, or feature requests, you grant OptiSwing a perpetual, irrevocable, worldwide right to use, modify, and incorporate such feedback into the Service without compensation or obligation to you.

5. Subscriptions & Billing

Certain features of the Service may require a paid subscription. Pricing, billing frequency, and plan details are presented at checkout.

By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel. You may cancel your subscription at any time, but no refunds are provided for partial billing periods, unless required by law.

6. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms or excessive or abusive usage.

Upon termination, your right to access the Service will immediately cease.

7. Limitation of Liability

To the fullest extent permitted by law, OptiSwing’s total liability for any claims arising out of or relating to the Service shall not exceed the amount paid by you to OptiSwing in the preceding twelve (12) months or $100 USD, whichever is greater.

In no event shall OptiSwing be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of data, profits, or performance.

8. Dispute Resolution & Arbitration

Any dispute arising from or relating to these Terms or the Service shall be resolved through binding individual arbitration, rather than in court.

You waive any right to participate in a class action lawsuit or class-wide arbitration.

9. Copyright & DMCA

We respect the intellectual property rights of others and comply with the Digital Millennium Copyright Act (DMCA).

If you believe that content on OptiSwing infringes your copyright, please contact us at support@optiswing.com . We will promptly investigate and remove infringing material where appropriate. Repeat infringers may have their accounts terminated.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of laws principles.

11. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
